‘Revoke this unconstitutional declaration’, labour leaders slam Tinubu on Fubara’s removal



 Leaders of the organised labour have called on President Bola Tinubu to revoke the State of Emergency declared in Rivers State.


The organised labour, comprised of the Nigeria Labour Congress (NLC) and the Trade Union Congress (TUC), also condemned the suspension of elected officers of the state including the Rivers State governor, Siminalayi Fubara and his deputy.


In a statement signed by Joe Ajaero, NLC president and Festus Osifo, his TUC counterpart, the organised Labour described Tinubu’s action as an unconstitutional overreach.


Messrs Ajaero and Osifo said the suspension of Fubara, his deputy and the Assembly lawmakers and the declaration of a State of Emergency is a direct assault on Nigeria’s democracy.


Also stating that Tinubu’s action is in violation of Part II of Section 305 of the Constitution as amended, the duo said the president’s action undermines the principles of a democratic system of government.


The labour leaders further called on the president to, as a matter of urgency revoke the state of emergency in compliance with Section 305(6) of the Constitution, which provides the legal framework for declaring and sustaining such decision.


The duo further warned that such an action from the president can constitute a threat to the autonomy of the sub-national governments.


They also noted that as the custodian of Nigeria’s executive powers, President Tinubu must learn to exercise restraint and have utmost respect for constitutional limits in a manner that inspires confidence rather than suspicion.


“No democratic society can thrive where elected leaders are arbitrarily removed at the whims of the President. This reckless move should deeply concern every reasonable governor and citizen who believes in the rule of law.


“We, therefore, call on Mr. President to revoke this unconstitutional declaration in compliance with Section 305(6) of the Constitution, which clearly outlines the legal process for declaring and sustaining a state of emergency,” the labour leaders said.


They added that the orgainsed labour would not remain silent in the face of such exhibition of undemocratic action by the president which its trickle effect can affect the lives of workers in Rivers State and Nigeria at large.
