“Recuse yourself from our Case” – Emefiele’s Lawyers tell Justice Oshodi

 


In a dramatic turn of events at the Lagos State Special Offences Court, the trial of former Central Bank of Nigeria (CBN) Governor Godwin Emefiele took a contentious twist on Monday as his legal team accused presiding judge Justice Rahman Oshodi of bias. The defense, led by Senior Advocates of Nigeria (SAN) Olalekan Ojo and Kazeem Gbadamosi, formally requested that Justice Oshodi recuse himself from further proceedings, citing prejudicial remarks made during the hearing.


The controversy erupted during the examination-in-chief of prosecution witness John Adetola, led by Economic and Financial Crimes Commission (EFCC) counsel Rotimi Oyedepo (SAN). Justice Oshodi reportedly stated in open court that allegations of Emefiele receiving bribe money had been “proven,” despite the trial still being in its early stages and cross-examination of the witness yet to commence. The defense argued that this statement indicates the judge has prematurely concluded the defendant’s guilt, undermining the integrity of the ongoing trial.


Olalekan Ojo (SAN), Emefiele’s lead counsel, expressed dismay at the judge’s remarks, stating, “This court granted an accelerated hearing on this matter, but what we are witnessing is an accelerated sentencing.” He emphasized that the judge’s comment, made before the defense could present its case or cross-examine the witness, suggests a predetermined outcome, violating principles of fair hearing.


Kazeem Gbadamosi (SAN), also representing Emefiele, echoed these concerns, asserting that Justice Oshodi’s assertion of proven bribery effectively convicts the former CBN governor before the trial’s conclusion. “Having stated that the allegation of collection of bribe money has been proven against the defendant, it is clear the defendant is already convicted in the mind of the judge,” Gbadamosi argued, urging the court to halt proceedings under Oshodi’s oversight.



The EFCC has charged Emefiele with 26 counts, including abuse of office and the irregular allocation of $4.5 billion and N2.8 billion, allegations he has denied. The trial, which resumed on Monday, February 24, 2025, has been closely watched due to its high-profile nature and implications for Nigeria’s financial governance.

Justice Oshodi adjourned the ruling on the recusal application to Wednesday, February 26, 2025, leaving the courtroom abuzz with speculation about the trial’s future.


The defense’s motion has sparked debates over judicial impartiality, with legal experts noting that such a recusal, if granted, could delay the case further.
